The Claims Administrator mailed Claim Forms the week of February 6, 2024 to Settlement Class Members whose purchase information is available. To be eligible for your share of the Settlement Fund, you must return the Claim Form by May 6, 2024. If you did not receive a Claim Form in the mail, you may contact the Claims Administrator at info@GenericDrugsDirectPurchaserSettlement.com. Your email should include the name and address of the potential Settlement Class Member.

NOTE: This settlement is only for direct purchasers. If you purchased these drugs from a retail pharmacy (e.g., Walgreens, CVS, Walmart, Rite Aid etc.), you are not a Settlement Class Member.

The Sun/Taro Settlements provided for the following payments by Settling Defendants: (1) $17,357,000 payment by Sun Pharmaceutical Industries, Inc. and its affiliates Caraco Pharmaceutical Laboratories, Ltd., Mutual Pharmaceutical Company, Inc., and URL Pharma, Inc. and (2) $67,643,000 payment by Taro Pharmaceuticals U.S.A., Inc. These payments (collectively $85,000,000) will comprise the total Sun/Taro “Settlement Fund.” The Sun/Taro Settlement Fund was reduced by $10 million pursuant to certain circumstances explained in the Sun/Taro Settlement Agreements.

On March 8, 2023, the Court held the Final Fairness Hearing to decide whether to approve the Settlements with the Sun and Taro Defendants, the Plan of Allocation for the Sun and Taro Net Settlement Fund to Settlement Class Members, and any requests by attorneys for reimbursement of expenses out of the Settlement Fund, payment of service awards to the Settling Direct Purchaser Plaintiffs, and any request to hold a portion of the Settlement Fund in escrow for potential payment of attorneys’ fees at a later date. On March 9, 2023, the Court entered an Opinion and Orders approving the Settlements, the Plan of Allocation, service awards, reimbursement of expenses, and a one-third set-aside for attorneys’ fees. On July 7, 2023, the Court entered an Order approving the Claim Form. On December 29, 2023, the Court approved DPP’s motion to amend the Plan of Allocation for the Sun and Taro Settlement and the Claim Form.
